1. PERSONAL DATA

We, MGLP Gered Rechtsanwalt GmbH, collect, process and use your personal data only with your consent or mandate or order for the purposes agreed with you or if there is any other legal basis in accordance with the GDPR; this in compliance with data protection and civil law provisions.

Only such personal data is collected as is necessary for the performance and processing of our legal services or which you have voluntarily made available to us.

Personal data are all data that contain details of personal or factual circumstances, for example name, address, e-mail address, telephone number, date of birth, age, sex, social security number, video recordings, photos, voice recordings of persons as well as biometric data such as fingerprints. Sensitive data such as health data or data relating to criminal proceedings may also be included.

2. INFORMATION AND DELETION

As a client or generally as a person affected, you have the right to information about your stored personal data, its origin and recipient and the purpose of the data processing as well as the right to correction, data transmission, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data at any time, subject to the obligation of legal confidentiality.

If there are any changes to your personal data, we request that you inform us accordingly.

You have the right to revoke your consent to the use of your personal data at any time. Your request for information, deletion, correction, objection and/or data transfer, in the latter case, provided that this does not involve a disproportionate amount of work, can be sent to the address of the law firm mentioned in point 10 of this declaration.

If you are of the opinion that the processing of your personal data by us violates the applicable data protection law or your data protection rights have been violated in any other way, you have the possibility to complain to the relevant supervisory authority. In Austria this is the responsibility of the data protection authority.

3. DATA SECURITY

The protection of your personal data is carried out by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorised, illegal or even accidental access, processing, loss, use and manipulation.

Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information that you disclose to us via the Internet may be viewed and used by other persons.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hack attack on e-mail account or telephone, interception of faxes).

4. USE OF THE DATA

We will not process the data made available to us for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. An exception to this is the use for statistical purposes, provided that the data provided has been made anonymous.

5. TRANSMISSION OF DATA TO THIRD PARTIES

In order to fulfil your order, it may also be necessary to pass on your data to third parties (e.g. opposing party, substitutes, insurance companies, service providers we use and to whom we make data available, etc.) courts or authorities. Your data will be forwarded exclusively on the basis of the GDPR, in particular for the fulfilment of your order or on the basis of your prior consent.

Furthermore, we would like to inform you that within the scope of our legal representation and support, we regularly receive information on facts and cases from third parties.

Some of the recipients of your personal data mentioned above are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection.

Furthermore, we transfer your personal data to service providers in non-EU countries which, in the opinion of the EU Commission, do not currently have an adequate level of data protection, although we take measures to ensure that all recipients have an adequate level of data protection, for which purpose we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).

6. NOTIFICATION OF DATA BREACHES

We make every effort to ensure that data breaches are detected at an early stage and, if necessary, immediately reported to you or the relevant regulatory authority, including the respective data categories that are affected.

7. STORAGE OF DATA

We will not retain data for longer than is necessary to fulfil our contractual or legal obligations and to ward off possible liability claims.

8. COOKIES

This website uses “cookies” to make our offer more user-friendly, effective and safer.

A “cookie” is a small text file that we send via our web server to the cookie file of the browser on the hard disk of your computer. This enables our website to recognize you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our website. The content of the cookies we use is limited to an identification number that no longer allows the user to be identified as a person. 9. SERVER LOG FILES

In order to optimise this website in terms of system performance, user-friendliness and the provision of useful information about our services, the provider of the website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your Internet Protocol address (IP address), browser and language settings, operating system, referrer URL, your Internet service provider and date/time.

A consolidation of these data with personal data sources is not carried out. We reserve the right to check this data subsequently if we become aware of concrete indications of illegal use.
